  • Breach: A second aspect to consider is a breach. You must be able to show that the duty owed to you was breached by the other individual due to their action or omission. Like in the previous car accident scenario, if you are injured due to another person running a red light and they hit your car, they breached their duty by not operating their car in a safe manner.

 

  • Causation: Once you have a duty and breach covered, you will need to then prove that the duty was breached by the individual/company caused you to be injured.
  • Damages: Finally, you will have to show the court that you suffered an injury. This could be a physical injury, emotional trauma, financial burden, etc.
